For consideration which holder acknowledges, holder expressly agrees:

All ticket sales are final. No money refunded. No exchanges in the event of a postponement of the race or event.  Special events are rain or shine. Artists / Drivers subject to change without notice.

The holder of this ticket expressly assumes all risk incident to the event, whether occurring before, during or subsequent to the actual event and agrees that all participants, sanctioning bodies and all employees, agents, officers and directors of Eastbound Park its affiliates and subsidiaries are thereby released from any and all claims arising from the event, including claims of negligence.

Holder Irrevocably grants to Eastbound Park and its agents, licensees, affiliates and subsidiaries/successors the right to use the holder’s image, likeness, voice missing word and or statements in all forms of media, including composites or modified representations for all purposes including advertising, trade or any other commercial purpose throughout the world and in perpetuity. Holder hereby waives any and all claims the holder may have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right arising out of or relating to any utilization of holders image as described herein.

 

Tickets and other admission materials:

 

• Obtained from sources other than Eastbound Park or the affiliates may be lost, stolen or counterfeit and in such cannot be honoured. Tickets may not be sold at a higher price than printed on the ticket. Tickets may not be sold at any price on Eastbound Park property.

• May not be used for advertising, promotions (including contests, sweepstakes or giveaways ) or any other trade purpose without prior express written consent of Eastbound Park

 

Eastbound Park owns all rights to broadcast, film, tape, capture, overhear,  photograph, collect or record by any means (including but not limited to: television, cable television, radio, pay-per-view, closed circuit television, satellite signal, digital signal and the internet) all images, sounds and data occurring before or during any Eastbound Park event and Eastbound Park shall be the sole owner of any and all intellectual property rights and proprietary rights worldwide  and in and to any other works copyrighted and otherwise created from the images, sounds and the data arising before or during any Eastbound Park event. The bearer of any ticket(s) purchased via this document agrees not to take any action or cause others to take action which would contravene, diminish or infringe upon the Eastbound Park rights.
